    Learn or review how to use the USHTS as a tool for classification and duty estimation. We will cover the General Rules of Interpretation, General notes, Chapter notes and headings.

    As part of the entry process, goods must be classified. 19 CFR 152.11

    Under 19 U.S.C. 1484, the "importer of record" under paragraph (2)(B), either in person or by an agent authorized by the party in writing, shall, using reasonable care by filing with the Customs Service the declared value, classification and rate of duty applicable to the merchandise.

    Prior to the Customs Modernization Act enacted on December 8, 1993, it was CBP’s responsibility to “classify” imported goods. Classifying goods is for duty purposes and determining whether the goods are subject to quotas, restraints, embargoes or other restrictions. CBP is now responsible for the final classification and valuation of the goods by a process called “liquidation” of the entry.

    Under 19 CFR 177 an importer may request a binding administrative ruling prior to importing.

    Jonathan C. Veley is the Director of Trade Systems at the U.S. Department of Agriculture, Agricultural Marketing Service. He is responsible for managing an agency wide portfolio of trade systems, including import/export certificate systems and international oversight systems. He also serves as a senior policy advisor for the agency on cross governmental program initiatives and leads the agency as the business owner for the international organic traceability and oversight system. 

    Prior to his role at USDA, Mr. Veley was the Chief of Readiness and Deployment, within the Office of Trade, at U.S. Customs and Border Protection (CBP). At CBP he was responsible for stakeholder engagement and end user support for the development, modernization, and change management initiatives for the Automated Commercial Environment (ACE).

    This webinar will provide customs brokers with a summary and explanation of what things CBP is doing with regard to enforcing accurate country of origin declarations.  This is extremely important given the movement of supply chains within Asia and to other regions, such as Mexico.  While there will be some discussion around rules of origin, the focus of the presentation will be geared more towards understanding the various tools that CBP (and other government agencies) are using to review and challenge inaccurate country of origin determinations, whether in the form of CBP Form 28’s, Audits, EAPA or other types of investigations/proceedings.

    Amanda Barlow is the Regional Vice President for Roanoke’s Western Region. Amanda oversees the sales and operations of the Long Beach and San Francisco offices. She is responsible for managing client relationships and directing sales initiatives with a focus on quality of service to ensure we deliver a superior client experience that serves as a sustainable differentiator for Roanoke in her region. Amanda seeks new business opportunities, and contributes to developing product and technology initiatives to ensure we are always meeting our clients’ needs and covering their risk exposures. She monitors underwriting practices, and ensures our brokerage operation is run consistently and efficiently. Amanda is a licensed insurance broker who specializes in ATA Carnets, cargo insurance, customs bonds, errors & omissions, and property & casualty for international trade and transportation specialists.

    Since Amanda has been with Roanoke she has severed in a variety of roles within the company. Most recently, Amanda was our Vice President of Client Experience which was focused on understanding our client’s needs whether from a risk management perspective, sales tools and support or simply how we can support our clients as they grow and evolve in the ever changing market place. Originally Amanda joined Roanoke in 2014 as the Vice President of ATA Carnet and she was responsible for the daily management of customer service operations, and sales of the ATA Carnet product and all its related services nationwide. Amanda’s career has been very focused on ATA Carnet and she is still involved in the strategic leadership and development of ATA Carnet, especially as we move into a digital environment.

    Amanda is a member of the Air Forwarders Association Board of Directors and is active in the AirCargo Conference Committee. The Air Forwarders Association serves as the voice of the air forwarding industry. Seeing industry issues emerge in a real time through Amanda’s involvement with the AFA allows her to better understand the ever changing risks of our clients. In addition, Amanda was appointed to the U.S. Department of Commerce’s District Export Council (DEC) of Southern California, one of more than 60 DECs that exist throughout the country to support the U.S. Government’s export promotion efforts.

    Amanda regularly presents on behalf of Roanoke for a wide variety of associations, department of commerce, and trade groups’ educational events, seminars and webinars. In 2018, she was appointed to the U.S. Department of Commerce’s District Export Council (DEC) of Southern California, one of more than 60 DECs that exist throughout the country to support the U.S. Government’s export promotion efforts. Amanda is a member of the National Customs Brokers and Freight Forwarders Association of America’s Educational Institute (NCBFAA-EI) Marketing Subcommittee, along with representing Roanoke and our clients in the Trade Support Network (TSN) and USCIB’s Customs and Trade Facilitation Committee. She served as the Secretary and Marketing Chair on the Organization of Women in International Trade (OWIT) New York chapter’s board of directors from 2009 until 2012, and is now an active member of the OWIT chapter in Orange County, CA.

    Amanda authored and taught for several semesters the Export Promotion Marketing course for the international trade and marketing department at her alma mater the State University of New York’s Fashion Institute of Technology (FIT-SUNY), where she has been an Adjunct professor since 2006. She has also served on FIT-SUNY’s Gemini Shippers Association’s Scholarship Committee, as well as their International Industry Advisory Board, which ensures that the curriculum is continually in line with industry advancements.

    Prior to joining Roanoke, Amanda was the Marketing Director in the Carnet and Trade Services Department of US Council for International Business (USCIB). She was responsible for the marketing, promotion and development of USCIB’s Trades Services. She joined USCIB in 2005 as an entry level ATA Carnet issuing representative, and moved very quickly into managing their trade services which included ATA Carnets, eCertificates of Origin and the international bookstore known for the sale of Incoterms®. Before joining the USCIB, Amanda worked with ATA Carnets for a New York-based Italian fashion house. She earned her Bachelor of Science Degree in International Trade and Marketing from FIT-SUNY.

    Gabriel Padilla is an Area Representative for the Federal Maritime Commission in the Los Angeles Office.  His duties include conducting investigations, inquiries, and outreach activities in the southwestern portion of the U.S. Mr. Padilla has extensive industry knowledge and previously served as the Customs & Border Protection Chief Agriculture Specialist in the Los Angeles/Long Beach seaport, where he led a team of specially trained Agriculture Specialists in their efforts to identify shipments that pose a significant risk to U.S. agriculture and natural resources. He began his government career with the United States Department of Agriculture in the Los Angeles/Long Beach seaport and majored in Agronomy and International Agriculture at Iowa State University.

    Mr. Harlow is the President of ITC-Diligence, Inc. ITC was founded in 2002 as a Licensed Customs Broker and International Trade Consultant with expertise in Foreign Trade Zones. Currently ITC represents the Riverside County, Port of Long Beach, Port of Jacksonville, and Las Vegas as well as many other businesses across the Nation with supply chain solutions and other Federal Programs.

    Mr. Harlow, a California native, received his U.S. Customs Brokerage License in 2004. He has spent the last 25 years specializing in the textile industry, footwear industry, and Foreign Trade Zone industry. He began his career with Fritz Companies and Norman Krieger. Mr. Harlow spends his free time actively participating in the FTZ, LACBFFA, NAFTZ, IVEDC, and LAEDC, with leadership roles in the IERCC and FTA, but most importantly with his wife, Dawn, and three children, Andrew, Adam, and Emma.

    Understanding the United States Harmonized Tariff Schedule (USHTS)

    Learn or review how to use the USHTS as a tool for classification and duty estimation. We will cover the General Rules of Interpretation, General notes, Chapter notes and headings.

    As part of the entry process, goods must be classified. 19 CFR 152.11

    Under 19 U.S.C. 1484, the "importer of record" under paragraph (2)(B), either in person or by an agent authorized by the party in writing, shall, using reasonable care by filing with the Customs Service the declared value, classification and rate of duty applicable to the merchandise.

    Prior to the Customs Modernization Act enacted on December 8, 1993, it was CBP’s responsibility to “classify” imported goods.  Classifying goods is for duty purposes and determining whether the goods are subject to quotas, restraints, embargoes or other restrictions.  CBP is now responsible for the final classification and valuation of the goods by a process called “liquidation” of the entry.

    Under 19 CFR 177 an importer may request a binding administrative ruling prior to importing.

He is a member of numerous customs, international trade, and legal associations. He is a past president of the Foreign Trade Association and Harbor Transportation Club. Mr. Roberts is an adjunct professor at California State University, Long Beach. He is a frequent presenter and author on topics related to his practice areas. He is a licensed customs broker (1989) and former transportation executive. He earned his B.A. degree in political science and international relations from California State University, Long Beach, and his J.D. degree, cum laude, from the Seattle University School of Law. Mr. Roberts has qualified as an expert witness in State and Federal courts, and is admitted to practice in California and Washington, the Court of International Trade and before the Federal Maritime Commission.
